NYC Tax Lien Reports

New York City has announced its Annual Lien Sale.

Below you will find Tax Lien Reports for the 5 boroughs of New York City.

General Lien Information

A lien is a legal claim against real property for unpaid property taxes, water, sewer or other property charges, as well as the interest due on these taxes and charges. When outstanding amounts have been delinquent for a legally specified period of time, and the property owner has received notice, the City is allowed to sell the lien(s) to an authorized third party, who becomes the “lienholder”. The new lienholder then has the authority to collect the money that was previously owed to the City of New York, plus other fees and interest.

When the City sells a lien, it is not selling the property. The new lienholder does not take title to the property. The lienholder purchases the right to collect the money that was owed to the City. Ultimately, however, if the property owner does not pay what is owed, the lienholder can begin a formal foreclosure proceeding in court.

In many ways this is equivalent to a preforeclosure or Lis Pendens. The distressed homeowner has fallen seriously behind in their obligations and must rectify the situation by either satisfying their debt, selling their property, or refinancing. If they do not they will go into foreclosure.

Individual investors can not buy tax lien. However as an investor you may be able to make arrangements with a home owner in default to sell you their property. As a Lender you may be able to offer the homeowner financing to satisfy their debt. As a real estate agent or broker you may be able to find a buyer for the homeowner if a sale is their desired option.

We encourage you to act in the most ethical manner and not to take advantage of homeowners who may be in distress.
